Acceptance of Terms ---------------------- By using Memorable Gift ("we", "us", "our") you agree to these Terms of Service. If you do not agree, please do not use the service. 2. The Service -------------- Memorable Gift is an AI-powered platform that creates personalised birthday songs. You provide details (recipient's name, age, preferences) and we generate a unique song delivered to you digitally. 3. Purchases & Payments --------------------------- All payments are processed by Paddle, our Merchant of Record. Prices are displayed in your local currency inclusive of applicable taxes. Payment is due at the time of purchase. By completing a purchase you authorise the charge to your chosen payment method. 4. Delivery ----------- Songs are delivered digitally via email and through your account within the stated generation time (typically 2–5 minutes). Delivery times may vary under high load. 5. AI-Generated Content ----------------------- Songs are generated by artificial intelligence. We take reasonable steps to ensure content is appropriate, original, and non-infringing, but we cannot guarantee any specific musical style, lyrics, or creative outcome. You are generally entitled to a refund if your song has not been successfully generated and delivered. 7. Acceptable Use ----------------- You may use the generated song for personal, non-commercial purposes. You may not resell, sublicense, or use the content for commercial purposes without our prior written consent. You must not use the service to create content that is harmful, defamatory, or infringes third-party rights. 8. Intellectual Property ------------------------ Subject to these terms and full payment, we grant you a non-exclusive, non-transferable licence to use the generated song for personal enjoyment. Memorable Gift retains all other intellectual property rights. 9. Disclaimer of Warranties --------------------------- The service is provided "as is". To the extent permitted by law, we disclaim all warranties, express or implied. 10. Limitation of Liability --------------------------- Our total liability to you shall not exceed the amount you paid for the relevant order. We are not liable for any indirect, incidental, or consequential losses. 11. Governing Law ----------------- These terms are governed by the laws of the Netherlands. Disputes are subject to the exclusive jurisdiction of the courts of the Netherlands. 12. Changes ----------- We may update these terms from time to time.
